I. Acceptance of Terms
By using healthkolscoaching.com or purchasing any services from HealthKols, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use our website or services.
II. Services
HealthKols provides online fitness coaching, nutrition guidance, and wellness programs delivered via the Everfit platform. Services are provided as described on our website and may be updated from time to time.
III. Health & Medical Disclaimer
This is an FTC-compliant disclaimer:
- Results shown are not typical. Individual results vary.
- HealthKols programs are not a substitute for professional medical advice, diagnosis, or treatment.
- Always consult your physician or healthcare provider before starting any fitness program, especially if you have pre-existing conditions.
- These statements have not been evaluated by the Food and Drug Administration (FDA).
- HealthKols programs are not intended to diagnose, treat, cure, or prevent any disease.
IV. Coaching Program Terms
- All programs are delivered via the Everfit platform.
- You are responsible for following the program as directed by your coach.
- Coach availability is limited to scheduled hours only.
- HealthKols reserves the right to terminate service for abusive behavior, non-compliance, or violation of these terms.
V. Payment & Billing
- All payments are processed securely through Stripe.
- VIP Coaching: 4-month commitment. Once you submit payment via Stripe, you are locked into all 4 payments. No cancellation is permitted during the initial 4-month window. After 4 months, the program continues on a month-to-month basis.
- Bootcamp Programs: Month-to-month billing with flexibility to cancel with proper notice.
VI. Cancellation Policy
- VIP Coaching: 4-month hard commitment from the date of your first Stripe payment. All 4 payments are due regardless of participation. After the 4-month period ends, you may cancel anytime with 30 days written notice via email to contact@healthkols.com.
- Bootcamp: Cancel anytime with 30 days written notice via email to contact@healthkols.com.
- Cancellation requests must be submitted in writing via email and are effective 30 days from the date of request.
VII. Refund Policy
- Coaching Services (VIP & Bootcamp): All sales are final. No refunds are issued. Exception: If we identify a verified payment error on our part, refunds will be issued within 14 days of the charge.
- Digital Products & Cookbooks: All sales are final. No refunds under any circumstances.
- Payment errors must be reported within 14 days of the charge.
VIII. Intellectual Property
All content on healthkolscoaching.com, including but not limited to text, images, videos, logos, and designs, is the exclusive property of HealthKols. You may not reproduce, copy, distribute, or transmit any content without prior written permission from HealthKols.
IX. User Conduct
You agree not to engage in any of the following conduct:
- Harassment, bullying, or threatening behavior toward coaches or other users.
- Spam or unsolicited marketing communications.
- Misuse of our services or platform.
- Illegal activity or violation of applicable laws.
X. Disclaimer of Warranties
Our services are provided on an "AS IS" and "AS AVAILABLE" basis. HealthKols makes no warranties, express or implied, regarding the services, including fitness results, health outcomes, or any specific benefits. We do not guarantee specific results or outcomes.
XI. Limitation of Liability
To the fullest extent permitted by law, HealthKols shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or business interruption, arising from your use of our services, even if we have been advised of the possibility of such damages.
XII. Indemnification
You agree to indemnify and hold harmless HealthKols, its owners, employees, and agents from any and all claims, damages, losses, liabilities, and expenses arising from your use of our services or your violation of these terms.
XIII. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
XIV. Changes to These Terms
We reserve the right to update or modify these terms at any time. Changes will be posted on this page, and your continued use of our services constitutes acceptance of the updated terms.
